Oppy is currently in Beta testing and not yet accepting public accounts and listings! Our launch date is October 30, 2026. See you then!

Terms and Conditions

Oppy Marketplace

Effective date: 14 October 2026

These Terms and Conditions ("Terms") govern your access to and use of Oppy Marketplace Pty Ltd (“Oppy”, “we”, “our”, “us”), including the Oppy website, mobile applications, related services, and any associated functionality (collectively, the "Platform").

The Platform is operated by:

Oppy Marketplace Pty Ltd

ABN: 22 698 396 137

ACN: 698 396 137

Contact:

admin@oppymarketplace.au

By creating an account, accessing, or using Oppy, you agree to be bound by these Terms. Your use of the Platform is also governed by the Oppy Privacy Policy. Where there is any inconsistency between these Terms and the Privacy Policy regarding privacy matters, the Privacy Policy will prevail.

1. About these Terms

These Terms are a legal agreement between you and Oppy Marketplace Pty Ltd. They apply when you browse, register, list, buy, sell, message, or otherwise use the Platform.

Oppy may modify these Terms from time to time. Updated Terms will be published on the Platform with a revised effective date. Continued use after updated Terms become effective constitutes acceptance of the revised Terms. If you do not agree, you should stop using the Platform.

2. The Platform

Oppy is an online marketplace that enables users to:

  • buy and sell art, handmade goods, upcycled items, second-hand goods and other permitted goods
  • communicate with other users
  • submit and negotiate offers where available
  • arrange shipping, delivery, or Oppy Local exchange
  • leave reviews
  • participate in disputes
  • and use marketplace services provided by Oppy

Oppy operates a marketplace. The seller of the goods is the user who lists or offers those goods. Oppy collects payment for those sales through Stripe, then pays the seller under these Terms.

Except where explicitly stated:

  • Oppy does not own listed items
  • Oppy is not the seller of listed goods
  • Oppy does not manufacture products
  • Oppy does not guarantee the quality, legality, safety, authenticity, or condition of listed items

The contract for the goods is between the buyer and the seller. Payment is processed by Oppy on the platform Stripe account, and the seller’s share is transferred later to the seller’s Stripe Connect account.

Oppy may expand to additional product categories, services, features, or marketplace offerings in the future. These Terms apply to such future services unless otherwise stated.

3. Eligibility and accounts

3.1 Eligibility

To use Oppy you must:

  • be at least 16 years old
  • provide accurate account information
  • comply with applicable laws
  • comply with these Terms
  • maintain account security

Users under 18 years of age should obtain permission from a parent or legal guardian before using the Platform.

Oppy may refuse, suspend, restrict, or terminate access to any user at its discretion where reasonably necessary.

3.2 User accounts

Users are responsible for:

  • maintaining account security
  • safeguarding login credentials
  • activities conducted through their account
  • ensuring account information remains accurate and current

You must not:

  • impersonate another person
  • create misleading accounts
  • create multiple accounts for fraudulent purposes
  • share accounts
  • attempt to bypass suspensions or restrictions

Oppy may suspend or terminate accounts where reasonably necessary to investigate fraud, enforce platform policies, protect users, comply with legal obligations, or maintain marketplace integrity.

4. Identity verification and seller payouts

4.1 Identity verification

Oppy may require users to provide identity verification information at any time. Verification may include government-issued identification, date of birth verification, payment verification, address verification, phone verification, and ownership verification of payment accounts.

Verification may be required for fraud prevention, dispute resolution, payout eligibility, legal compliance, and platform safety.

Failure to provide requested information may result in delayed payouts, restricted functionality, transaction limitations, listing removal, account suspension, or permanent account closure.

4.2 Seller payouts

Users may be required to create, maintain, and verify a Stripe Connected Account in order to receive payouts and to publish listings for sale.

Seller proceeds are not automatically released immediately after payment. Funds may be held until the buyer confirms the item was received and satisfactory, the applicable acceptance period expires, disputes are resolved, fraud checks are completed, or Oppy otherwise determines funds may be safely released.

Open disputes may delay payouts.

Oppy reserves the right to delay, suspend, withhold, reverse, recover, or cancel payouts where reasonably necessary for fraud prevention, chargebacks, disputes, policy violations, or legal obligations.

Oppy does not guarantee payout timing.

5. Listing rules

5.1 Marketplace listings

Users are solely responsible for listings they create, information they provide, images they upload, representations they make, and prices they set.

Listings must:

  • accurately describe the item
  • include genuine photographs
  • disclose significant flaws or defects
  • comply with applicable laws
  • comply with Oppy policies

For art, handmade, and upcycled listings, sellers must accurately describe authorship, materials, techniques, dimensions (where relevant), and condition. Do not present replica, misattributed, or misleading work as original or authentic.

Oppy may remove listings without notice where they breach these Terms, create safety concerns, contain misleading information, violate intellectual property rights, or involve prohibited items.

5.2 Prohibited items

The following items are prohibited:

  • counterfeit goods
  • replica designer products
  • stolen goods
  • illegal goods
  • weapons
  • ammunition
  • controlled substances
  • tobacco products
  • vaping products
  • unsafe cosmetics
  • recalled products
  • hazardous materials
  • digital-only products
  • event tickets
  • animals
  • goods that infringe intellectual property rights
  • any item Oppy determines is inappropriate

Permitted exceptions:

  • used swimwear
  • new underwear in unused condition

Oppy may remove listings and suspend accounts associated with prohibited items.

5.3 Intellectual property and counterfeit goods

Users must not upload, list, sell, advertise, or distribute counterfeit or infringing products.

Rights holders may report alleged infringement by contacting: admin@oppymarketplace.au

Where infringement is suspected, Oppy may remove listings or content, restrict accounts, hold funds, suspend users, or permanently ban users. Repeated violations may result in permanent removal from the Platform.

5.4 Public profiles

Oppy provides public profile functionality. Information displayed publicly may include username, profile photo, bio, reviews, active listings, sold listings, and seller ratings.

Users acknowledge that information voluntarily included in public profiles may be visible to other users, search engines, and members of the public.

5.5 Holiday Mode

Oppy may provide a Holiday Mode feature allowing sellers to temporarily pause purchases. When Holiday Mode is enabled, listings may remain publicly visible, buyers may be prevented from purchasing items, and offers and communications may remain available.

Oppy does not guarantee that Holiday Mode will prevent all interactions.

6. Buying and selling

6.1 Messaging and communications

Oppy provides messaging functionality between users.

Users must not harass, threaten, or abuse others, spam users, send unlawful content, engage in scams, or attempt fraud.

Oppy may access, review, preserve, and disclose communications where reasonably necessary for dispute resolution, fraud prevention, user safety, legal compliance, or enforcement of these Terms.

Oppy reserves the right to remove content or restrict messaging privileges where necessary.

6.2 Offers and negotiations

Oppy may permit users to submit offers on listings. Offer functionality may include offers, counteroffers, acceptance, and rejection.

Offers are available on Second-hand listings. Art, Handmade, and Upcycled listings are generally buy-at-listed-price (plus messaging) and do not support Make Offer, counter, or accept-offer flows.

Acceptance of an offer does not guarantee completion of a transaction. An item is generally considered sold only after successful payment processing through Oppy’s checkout systems.

Oppy may cancel offers or transactions where fraud, error, abuse, or policy violations are suspected.

6.3 Reviews and ratings

Oppy may permit users to leave reviews and ratings. Reviews must be truthful, relate to genuine transactions, and must not be abusive, defamatory, or unlawful.

Oppy may remove reviews that are fraudulent, abusive, misleading, irrelevant, defamatory, or inconsistent with marketplace integrity. Oppy does not guarantee the accuracy of reviews submitted by users.

6.4 Off-platform transactions

Users must not attempt to avoid Oppy's systems, protections, or fees by directing transactions outside the Platform.

Examples include:

  • requesting direct bank transfers
  • requesting payment through third-party apps
  • sharing payment details to complete purchases outside Oppy
  • arranging purchases outside Oppy after initial contact through the Platform

Oppy is not responsible for transactions conducted outside the Platform. Users engaging in off-platform transactions may lose access to dispute resolution processes, payment protections, and marketplace support.

Oppy may restrict or terminate accounts that repeatedly attempt to circumvent marketplace systems.

7. Fees and payments

7.1 Payments and Stripe

Oppy uses Stripe and related payment providers to facilitate marketplace transactions.

By using Oppy, you agree to applicable Stripe services agreements, connected account agreements, payment provider terms, and payment provider privacy policies.

Checkout may offer card payments and, where available on your device and region, wallet or other methods such as Apple Pay, Google Pay, and buy-now-pay-later options enabled through Stripe. Availability depends on the payment provider, your device, and your account.

Oppy does not store full credit card numbers. Oppy is not responsible for the operation, availability, or decisions of third-party payment providers.

Oppy may refuse, delay, restrict, or suspend payment functionality where reasonably necessary for fraud prevention, legal compliance, payment provider requirements, platform safety, dispute resolution, or marketplace integrity.

7.2 Oppy fee

Buyer checkout shows an Oppy fee. This supports customer support, secure payments, dispute resolution, and the smooth operation of Oppy Marketplace. The fee is calculated on the item price (not postage), and shown before you pay and paid by the buyer.

The Oppy fee is:

  • Under $15 — $1.20 + 2.5% of the item price
  • $15 – $100 — $0.99 + 5% of the item price
  • Above $100 — $4.99 + 2.5% of the item price

Oppy does not charge seller listing or commission fees for ordinary marketplace sales. Sellers receive sale proceeds subject to these Terms, Stripe Connect requirements, and any amounts held, recovered, or adjusted under platform rules.

7.3 Market Mode and in-person card payments

Market Mode lets a seller take a contactless card or digital-wallet payment in person using Tap to Pay on iPhone, through Stripe Terminal. The buyer pays the agreed price only. The Market Mode fee is paid by the seller. It is deducted from the amount transferred to the seller. Oppy does not add a card surcharge on top of the agreed price.

The Market Mode fee is 1.65% of the agreed price plus $0.80. The Market Mode fees supports the smooth operation of Oppy Marketplace Market Mode. The fee is shown to the seller before they start the tap.

Oppy takes the payment for the stall sale. The seller remains the supplier of the goods. Oppy then pays the seller the agreed price minus the Market Mode fee and any refund already made, the same way online payouts are released. The receipt names the stall and, where the seller has given one, the seller’s ABN. It also records that payment was taken by Oppy Marketplace Pty Ltd (ABN 22 698 396 137) for that sale. The seller must offer the buyer a digital receipt.

A seller who is selling in trade or commerce must meet the consumer guarantees in the Australian Consumer Law, including acceptable quality, matching the description, and a remedy if those guarantees are not met. A one-off private sale that is not in trade or commerce does not carry the full set of consumer guarantees, but the buyer still has guarantees as to title, undisturbed possession, and that the goods are free of undisclosed securities. Oppy does not decide for a buyer whether a particular stall sale is in trade or commerce.

Nothing in this section limits rights that cannot be excluded under the Australian Consumer Law, the Reserve Bank of Australia’s surcharge standard, or other applicable law.

8. Shipping and Oppy Local

8.1 Shipping and delivery

Oppy supports various fulfilment methods, including:

  • Oppy Postage
  • seller-managed shipping
  • MyPost Business labels arranged through Oppy
  • Oppy Local exchange
  • and other options that may be introduced from time to time

Sellers are responsible for dispatching sold items, providing accurate shipping information, packaging items appropriately, complying with shipping requirements, and communicating honestly regarding delays.

Buyers are responsible for providing accurate delivery information, monitoring shipment progress, and reporting issues promptly.

Oppy does not guarantee shipping times, delivery dates, carrier performance, or successful delivery outcomes.

8.2 Oppy Postage and carrier labels

Where Oppy Postage or MyPost Business shipping is selected, shipping labels may be generated through third-party providers, shipping information may be shared with carriers, tracking information may be generated and stored, and administrative shipping processes may be performed by Oppy or the seller’s connected MyPost Business account.

Users must provide accurate shipping details.

Oppy is not responsible for carrier delays, carrier losses, carrier errors, weather events, customs delays, or third-party logistics failures.

8.3 Oppy Local

Oppy Local allows a buyer and seller to complete an order through an in-person exchange at an agreed place and time, instead of postage.

Payment for Oppy Local orders is still processed through Oppy’s checkout systems. Users must not arrange off-platform payment for Oppy Local orders.

Buyers and sellers are solely responsible for arranging, attending, and completing the meetup safely. Oppy is not a party to the meetup, does not supervise exchanges, and does not guarantee that either party will attend or that the item will change hands as expected.

Users should choose public, familiar locations, take ordinary personal safety precautions, and use Oppy’s in-app meetup and exchange tools where available. Oppy may cancel Oppy Local orders that are not completed within platform deadlines and may refund buyers according to Oppy Local and cancellation rules then in force.

Disputes, held funds, and refunds for Oppy Local orders remain subject to these Terms and Australian Consumer Law.

9. Orders, cancellations, disputes, and refunds

9.1 Buyer acceptance and automatic completion

Oppy may require buyers to confirm whether an order has been received and is satisfactory.

If a buyer confirms satisfactory receipt, does not report a problem within the applicable review period, or otherwise takes no action, Oppy may automatically treat the transaction as completed.

Upon completion, Oppy may release seller funds, close transaction review periods, and finalise marketplace records. Users acknowledge that inactivity may result in automatic transaction completion.

9.2 Order cancellation

Cancellation is available only before an order is posted (or, for Oppy Local, before exchange completion under Oppy Local rules). A seller may cancel an unposted order. In that case, the buyer receives the item price, postage (if any), and most of the Oppy fee. A small part of the Oppy fee is retained.

A buyer may submit one cancellation request for an unposted order. Fulfilment pauses while the request is pending. The seller may accept or decline the request. Declining closes the buyer’s request (the buyer cannot submit another for that order); the seller may still cancel the sale before posting.

  • if the seller accepts the buyer’s request, the item price and postage are refunded and the Oppy fee is retained
  • if the seller declines the request, the order continues and the buyer cannot submit another cancellation request for that order; the seller may still cancel the sale before posting
  • if the seller does not respond within five days from the request time and the order has not progressed, Oppy may automatically cancel it and refund the item price, postage, and most of the Oppy fee, while a small part of the Oppy fee is retained
  • if a seller-managed order is not posted within 10 days, Oppy may automatically cancel it under the same seller-inactivity refund treatment

Automatic cancellation does not apply after posting, tracking progression, an active dispute, payout release, or another protected fulfilment event. Oppy may also cancel transactions where fraud, error, prohibited items, abuse, or policy violations are identified.

Where practical, affected users will be notified. Nothing in this cancellation policy limits rights under Australian Consumer Law.

9.3 Disputes

Oppy may provide dispute resolution tools and workflows. Disputes may include item not received, item significantly not as described, damaged goods, incorrect items, and other eligible transaction issues.

Oppy may request photographs, videos, tracking records, communication records, return evidence, and supporting documentation. Users agree to cooperate with reasonable requests during dispute investigations.

9.4 Dispute resolution outcomes

Oppy may determine outcomes including full refunds, partial refunds, return of goods, release of held funds, denial of claims, account restrictions, or additional investigation.

Oppy's dispute tools help buyers and sellers reach an outcome. Using those tools does not limit rights that cannot be excluded under Australian Consumer Law. You can contact Oppy Support at any time.

Oppy reserves the right to act based on available evidence where information is incomplete.

9.5 Returns

Oppy may facilitate return arrangements between buyers and sellers. Users remain responsible for complying with return instructions provided during dispute resolution.

Failure to cooperate with agreed return processes may affect dispute outcomes. Oppy may consider tracking records and delivery confirmation when assessing return-related disputes.

9.6 Refunds

Refunds may be issued through dispute resolution, following transaction cancellation, due to payment processing errors, or where otherwise required by law.

Cancellation refund amounts follow the Order Cancellation section. When a seller accepts a buyer-requested cancellation, the Oppy fee is retained. For a seller-initiated cancellation, and for an eligible automatic cancellation after seller inactivity, most of the Oppy fee is refunded and a small part is retained.

Oppy does not guarantee refunds for change of mind, sizing issues, buyer preference, delays outside seller control, or expected wear in second-hand goods.

Nothing in these Terms excludes rights under Australian Consumer Law.

9.7 Market Mode refunds

For a Market Mode tap, the seller can issue a full or partial refund in the app during the eight-hour hold, before Oppy transfers the seller’s share. That hold is an operational window for a same-day stall refund. It is not a time limit on the buyer’s rights.

After the hold, or if the in-app refund is not used, a buyer may still contact the seller or Oppy Support. Where Australian Consumer Law requires a remedy, Oppy may refund from the original charge or recover the amount from the seller, including after the transfer.

Oppy does not guarantee a change-of-mind refund on a stall sale. A change of mind is not the same as a failure to meet a consumer guarantee.

9.8 Chargebacks

Users must not improperly initiate chargebacks or payment disputes.

Where Oppy reasonably believes a chargeback is fraudulent, abusive, misleading, or inconsistent with platform records, Oppy may suspend accounts, withhold payouts, recover funds, restrict marketplace access, or pursue legal recovery where appropriate.

Users remain liable for losses caused by fraudulent chargeback activity.

10. Content, privacy, tax, and notices

10.1 User content

Users retain ownership of content they upload to Oppy, including listing images, profile images, descriptions, reviews, messages, and other submitted content.

By uploading content, users grant Oppy a worldwide, non-exclusive, royalty-free licence to host, store, display, distribute, modify for technical purposes, and promote such content for the operation, improvement, and promotion of the Platform.

Users warrant they have the right to upload and use all content submitted to Oppy.

10.2 Oppy intellectual property

The Oppy name, branding, logos, design elements, software, content, and platform functionality remain the property of Oppy Marketplace Pty Ltd or its licensors.

Users must not copy, reproduce, distribute, modify, reverse engineer, or commercially exploit any part of the Platform without prior written permission.

Nothing in these Terms transfers ownership of Oppy's intellectual property to users.

10.3 Privacy

Use of Oppy is also governed by the Oppy Privacy Policy. By using the Platform, users acknowledge that personal information may be collected, stored, used, and disclosed in accordance with the Privacy Policy.

10.4 Tax responsibilities

Users are solely responsible for determining tax obligations, reporting taxable income, complying with tax laws, and maintaining appropriate business records.

Oppy does not provide accounting, taxation, financial, or legal advice. Users should seek independent professional advice where required.

10.5 Electronic communications

By using Oppy, users consent to receiving communications electronically. These may include receipts, transaction notices, dispute updates, account notifications, legal notices, policy updates, and marketing communications where permitted.

Users are responsible for maintaining a valid email address and ensuring emails from Oppy can be received.

10.6 Marketplace safety and automated systems

Oppy may investigate listings, accounts, transactions, disputes, reviews, communications, and payment activity. Oppy may take enforcement actions including content or listing removal, transaction cancellation, payout restrictions, account suspension, and permanent bans. Serious matters may be referred to law enforcement or relevant authorities.

Oppy may use automated systems to process transactions, send reminders, monitor platform activity, detect fraud, release funds, manage disputes, enforce platform rules, and improve marketplace safety. Users acknowledge that certain marketplace actions may be performed automatically based on platform rules and transaction status.

11. Liability, termination, and law

11.1 No warranties

To the maximum extent permitted by law, Oppy provides the Platform on an "as is" and "as available" basis.

Oppy does not warrant that the Platform will be uninterrupted or error-free, that listings will be accurate, that items will be authentic, that transactions will be completed, that messages will be delivered, that shipping or Oppy Local exchange will occur successfully, or that users will act lawfully.

Marketplace transactions involve inherent risk. Users acknowledge and accept these risks.

11.2 Limitation of liability

To the maximum extent permitted by law, Oppy and its directors, officers, employees, contractors, agents, and affiliates are not liable for user conduct, listing accuracy, counterfeit items, item quality, transaction outcomes, payment provider actions, shipping failures, delivery delays, lost parcels, meetup or Oppy Local exchange outcomes, indirect losses, consequential losses, loss of profits, loss of opportunity, loss of goodwill, or loss of data.

Where liability cannot legally be excluded, Oppy's liability is limited to the maximum extent permitted by law.

11.3 Indemnity

Users agree to indemnify and hold harmless Oppy Marketplace Pty Ltd and its directors, officers, employees, contractors, and agents from claims, losses, liabilities, damages, costs, and expenses arising from breach of these Terms, unlawful conduct, infringement of intellectual property rights, misuse of the Platform, disputes with other users, inaccurate listings, prohibited items, or fraudulent activity.

11.4 Force majeure

Oppy is not liable for delays, failures, interruptions, or inability to perform obligations caused by events beyond reasonable control.

Examples include natural disasters, floods, fires, storms, internet outages, cyberattacks, carrier disruptions, labour disputes, government actions, infrastructure failures, and pandemics.

Oppy may suspend services during such events without liability.

11.5 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies rights that cannot legally be excluded, restricted, or modified under Australian Consumer Law or other applicable legislation.

Where guarantees or rights apply under law, those rights continue to apply.

11.6 Suspension and termination

Oppy may suspend, restrict, or terminate access to the Platform at any time where reasonably necessary.

Reasons may include fraud, policy violations, unlawful conduct, abuse of other users, prohibited items, payment abuse, chargeback abuse, or security concerns.

Termination may include account closure, listing removal, payout restrictions, and transaction cancellation.

Users may stop using the Platform at any time. Certain provisions of these Terms survive termination, including dispute provisions, liability limitations, indemnities, intellectual property provisions, and payment obligations.

11.7 Governing law

These Terms are governed by the laws of New South Wales, Australia.

Users agree to submit to the exclusive jurisdiction of the courts of New South Wales and Australia for disputes arising in connection with these Terms or use of the Platform.
